Advance Directive By STATE

What is Advance Directive?
Life takes unexpected turns. In today’s world, it is important to plan ahead for unexpected critical health issues. That is why it is important to have an Advanced Directive. Make your wishes known before it’s too late.

Advance directive is both an umbrella term for defining and expressing how one wants to live and be treated and for state approved advance directive documents which allow you to specify those things and usually to appoint a person (healthcare power of attorney) to speak when you are unable to speak for yourself.

Digital Estate Planning Laws By STATE

At least 42 states since 2013 have enacted laws addressing access to email, social media accounts, micro-blogging or other website accounts, or certain electronically stored information, upon a person’s incapacity or death. Nevada law provides for the termination of decedents’ social media accounts.

The Uniform Law Commission (ULC) in 2014 approved the Uniform Fiduciary Access to Digital Assets Act (UFADAA) and in July 2015, the ULC issued a revised version of UFADAA–the Fiduciary Access to Digital Assets Act, Revised (2015). Model legislation was also developed by Netchoice, the Privacy Expectations Afterlife and Choices Act (PEAC). The ULC chart, Comparison of UFADAAPEAC and Revised UFADAA, details the provisions of the three model acts. –Courtesy of the National Conference of State Legislatures (ncsl.org, 2017)
